1. General Information and Agreement to Terms

These terms and conditions apply between you, the Member of this Website, whether personally or on behalf of an entity (including any sub-domains, unless expressly excluded by their own terms and conditions), and Silverhammer Auctions Ltd (We, Us, Silverhammer Platform, Marketplace Operator), the owner and operator of this Website. These Terms and Conditions set out the terms of use and access to the Website https://silverhammercoinauctions.co.uk.

Please read these terms and conditions carefully, as they affect your legal rights.

To ensure that the Website is a safe and secure online environment for all Members to enjoy, all Members of the Website must agree to and comply with these Terms and Conditions, including any other parts incorporated by reference.

Use of the Website is also governed by our Support Center FAQ pages which are incorporated into these terms and conditions by this reference.

Should there be any discrepancy between these Terms and Conditions and The Support Center FAQ pages then these Terms and Conditions wording will take priority.  

Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Website. You must have the legal capacity to understand, agree and comply with these Terms and Conditions.

If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

1.1 We reserve the right in our sole discretion to modify or make changes to these Terms and Conditions from time to time as deemed necessary. We will notify you about any changes and mark these changes by date stamp but we exclude any obligation to issue a specific notice for any such changes. You agree to monitor, check and understand all Terms and Conditions and by continuing to use the Website you agree to the current wording and revisions of these Terms and Conditions made available to you. 

1.2 We reserve the right to monitor the Website for any violations of these Terms and Conditions, and to take appropriate action against any Member or entity who violates any of the terms of these Terms and Conditions. This is at our sole discretion. 

1.3 Without any limitation we may report any user who violates these Terms and Conditions to relevant authorities, and suspend or restrict access to their account.

1.4 In these terms and conditions, Member or Members means any third party User, an individual or any business entity, that accesses the Website and is not either (i) employed by Silverhammer Auctions Ltd and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Silverhammer Auctions Ltd and accessing the Website in connection with the provision of such services.

1.5 The Website is a multi-seller online marketplace and an online community dedicated to collectors and professionals of collectible items that can be generally described as numismatic items including coins, tokens, banknotes, commemorative and military medals. These items should be considered as collectible with historical significance or monetary and/or intrinsic value, or carrying a numismatic premium, or fit in one or more of the item categories available on this Website including professional publications, periodicals, or collector’s equipment, storage and tools. 

1.6 The Marketplace Operator offers the Website Services and Community features as a Social Network (Website Services) to facilitate trade between Seller and Buyer of collectors’ items. 

1.7 Silverhammer Auctions Ltd, the Marketplace Operator, does not provide guarantees as to accuracy, availability, prices, listings, auctions, ratings, reviews, or legality of any information available or published on the Website, and any Website Services available.

  

1.8 You agree to not raise any claims against Us, the Marketplace Operator, from any errors or omissions and misrepresentations made on this Website. We are not selling anything on this Website, unless otherwise stated, and do not form any legal contract between buyers and sellers. The Marketplace Operator is Service Provider and only facilitates trade on The Website by providing space to do so. We do not accept any responsibility for any damage or loss or misunderstanding. You agree that you act on your own behalf and at your own risk.

1.9 Both the Buyer and the Seller enter a Contract of Sale/Purchase Agreement upon the sale, and are bound by the terms of the contract. Any dispute arising in connection to the Contract of Sale/Purchase Agreement is between the Seller and the Buyer. 

1.10 The Marketplace Operator may step in to help resolve any issues but does not accept any responsibility or obligation. 

1.11 This Website and all its content is not intended for distribution or use by any individual (Member) or entity in any jurisdiction that would subject the owner and the Marketplace Operator to any requirement, registration or regulation(s) within such jurisdiction or geographical region. If you access this Website from an overseas location you do so by intent and are solely responsible to comply with your local laws applicable to you.  

1.12 You must be at least 18 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.

1.13 The Website is available to all members to visit for free. Certain features or Website Services require payment or valid subscriptions as stated on our Prices and Fees page. 

1.14 Silverhammer Auctions Ltd is based in the United Kingdom. Official time Zone is London, England, UK. Official currency is  Pounds Sterling (GBP).

2. Intellectual Property and Acceptable Use

2.1 All Content included on the Website, unless uploaded by Members is the property of Silverhammer Auctions Ltd, our affiliates or other relevant third parties. In these terms and conditions Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Members. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting by implication, estoppel, or otherwise, any licence or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission.

2.2 You may, for your own personal, non-commercial use only, do the following:

a. retrieve, display and view the Content on a device

b. List for sale or auction collector items that belong to you, or with other owners permission, that fit one or more listing category available on the website

c. Sell items, or purchase items listed by other members

d. Interact with content by replying to activity, sending messages, uploading graphics or video clips, join groups, and participate in forums.

2.3 You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of Silverhammer Auctions Ltd.

2.4 Using Silverhammer Auctions Ltd trademarks, including our ‘trading as’ logos, graphics or other names associated without a written permission is prohibited. You agree not to use our trademarks on any social media platforms, online groups or forums, third-party websites or for any other purpose or reason other than is permitted in a granted written permission. You agree not to impersonate a Silverhammer Auctions Employee or have an affiliation with us in any way. 

2.5 You acknowledge that you are responsible for any Content you may submit via the Website, including the legality, reliability, appropriateness, originality and copyright of any such Content. You may not upload to, distribute or otherwise publish through the Website any Content that:

(a) is confidential, proprietary, false, fraudulent, libellous, defamatory,

obscene, threatening, invasive of privacy or publicity rights, infringing on intellectual property rights, abusive, illegal or otherwise objectionable; 

(b) may constitute or encourage a criminal offence, violate the rights of a party or otherwise give rise to liability or violate any law; or 

(c) may contain software viruses, political campaigning, chain letters, mass mailings, or any form of “spam.” You may not use a false email address or other identifying information, impersonate any person or entity or otherwise mislead as to the origin of any content. You may not upload commercial or advertising content onto the Website.

2.6 You represent and warrant that you own or otherwise control all the rights to the Content you list for sale or otherwise share; that the Content is accurate; that use of the Content you supply does not violate any provision of these terms and conditions and will not cause injury to any person; and that you will indemnify Silverhammer Auctions Ltd for all claims resulting from Content you supply.

2.7 Silverhammer Auctions Ltd is committed to protect and respect the Intellectual Rights of others. If you believe any of the Website content infringes any rights you own, please alert us at your earliest opportunity via email or the Contact Us page. 

2.8 We will notify a Member who you believe infringes or has infringed your rights.

If you make any misrepresentations in the Alert you may be liable for any consequent damages therefore you need to have proof that you own the rights to the Content in question.

3.Prohibited Use

3.1 You as a Member agree that you will not access the Website or use it for any illegal or unauthorised purpose and by using the Website you will not violate any applicable laws and regulations. 

3.2 You may not use the Website for any of the following purposes:

3.3 in any way which causes or may cause damage to the Website or interferes with any other person’s use or enjoyment of the Website

3.4 in any way which is harmful unlawful illegal abusive, harassing, threatening or otherwise objectionable or in breach of any applicable law regulation or governmental order

3.5 making transmitting or storing electronic copies of Content protected by copyright without the permission of the owner

3.6 collect data or other content to create a database of the data without written permission from us the OMP (Operator of The Marketplace)

3.7 use any software scripts or comments data mining robots cookies or other data gathering tools

3.8 attempt to maliciously collect any information about other members, including personal information, or access information such as login credentials

3.9 attempt to disable and/or to interfere with security features of the Website including any security features that prevent gaining access to sensitive information or lifting these restrictions including any limitations to restrict access to the Website or any part of the Website

3.10 attempt to insert any malicious code including viruses, trojan, spiders, web bugs or use other malicious code including passive or active information collection mechanisms such as malware or spyware

3.11 attempt to use any automatic bidding software or buying agent to make any purchases on the Website

3.12 misuse any of our Support Centre features or falsely flag or report any Member or content

3.13 attempt to gain access to another Member account without their permission or use their login credentials

3.14 advertise or offer for sale any items outside of the Website space designed for such activity such as Community Activity Wall Groups or Forums.

3.15 conduct Gambling or Games or similar activity to offer items for sale or any other activity of any items changing their owner 

3.16 engage in any activity that could be considered as fee-dodging and/or Seller Commissions or Customer Premiums avoidance when monies are due to the Marketplace Operator or other Member including moving communications outside of any communication channels provided on this Website  

3.17 engage in any activity to fraudulently gain points (SHCA Coins) by any activity that would violate these Terms and Conditions or any applicable laws. We reserve the right to amend or distract SHCA Coins from your points account for any reason

3.18 use this Website in a way that does not comply with these Terms and Conditions or any laws applicable to you or endorsed by us the Website Operator

 

3.19 list for sale any unauthorised items such as but not limited to illegal drugs or medication prescribable medications steroids or other regulated substances, alcohol, pornography, adult content, nudity, weapons of any kind, animals or other living species, plants, music and video or films 

3.20 list for sale any items that are Fakes or Counterfeits or Copies that are not described as such.

3.21 We reserve the right to remove or delete permanently any listings containing any prohibited content or features without a notice, and suspend or terminate your account if any breaches of these Terms and Conditions occurred. 

4. Registration and Account

4.1 In order to use the Marketplace and Online Community of the Website you must register and become a Member. When you register on this Website, you will be asked to create a password and you agree to keep your login credentials secure and confidential and take responsibility for use of your account. 

4.2 If we have reason to believe that there is or is likely to be any misuse of the Website or breach of security, we may require you to change your password or suspend your account.

4.3 You must ensure that any personal or business details provided by you on registration or at any time are true, correct and complete.

4.4 You must inform us immediately of any changes to the information that you provide when registering by updating your personal or business details, and keep them up to date at all times to ensure we can communicate with you effectively.

4.5 You must be over 18 years old to register on this website.

4.6 We may suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions, especially if you provide invalid, inaccurate or incomplete information.

4.7 You may cancel your registration at any time by informing us in writing. If you do so, you must immediately stop using the Website. Cancellation or suspension of your registration does not affect any statutory rights.

5. Payments

5.1 Accepted Payments

5.1.1 We accept major credit and debit cards via our payment processor Stripe, including Visa, Mastercard, Discover, Amex or prepaid cards like JCB.

5.1.2 In addition, we provide the SHCA Coins Payment (points) Gateway for Members to make purchases using their points collected on their accounts. Currently Members can use SHCA Coins Gateway to pay for items in their cart in full. The getaway will be available at the checkout only if the Member has enough points to cover the whole cart value.

5.1.3 Visit our Support Center for Points-based Reward Program (loyalty programme) Terms and Conditions.

5.2 Processor (Automatic Payouts)

5.2.1 We work with trusted payment providers to ensure safety and security of all users. Upon registration sellers need to create and connect their Payment Processor account to the Marketplace to receive seamless automatic payouts. 

5.2.2 Currently we offer payment processing and splitting between us and the seller via Stripe.

5.3 Manual Payouts

5.3.1 If Sellers do not connect their account to the Stripe account, we may, at certain times, and at our own discretions allow them to list and sell their items temporarily, especially during their Subscription Trial Period.

5.3.2 We may disable Sellers selling capacities at any time and without giving any reasons.  

5.3.3 If the Seller’s account is not connected to our payment processor Stripe, then upon a sale of an item all earnings will be transferred to the Marketplace Operator account. 

5.3.4 Sellers will need to request a manual payout to receive their funds. This attracts a fee as described on our price and fees page. The Seller ID verification is required for the payment to be approved and processed accordingly. We strongly recommend that all Sellers connect their payment processor Stripe account to the Marketplace account for enhanced security and seamless automatic payouts as soon as possible to avoid incurring extra fees and longer waiting times.  

5.3.5 We reserve the right to temporarily decline to proceed with a manual payout, and hold the funds, if we are obligated to do so, or if sellers do not verify their identity, or when their activities meet criteria for reporting for tax fraud prevention purposes, or if there is an investigation ongoing regarding their activity. 

5.3.6 If you are not registered as a Business Seller we may need to carry relevant checks to verify if your activity could be considered as fraudulent or for business purposes, and if you should be paying any tax, and report your activity on this Website to relevant authorities.

5.3.7 We reserve the right to report your activities for any relevant authorities and you give us the right to do so. 

5.3.8 We reserve the right to suspend your account and withhold your funds if we suspect that your activity is fraudulent, or a crime has been committed. We  work closely with the tax authorities and the police and may be required to share information about you, and your activity on our platform. 

5.3.9 If we are required to withhold any funds, you will not be entitled to claim or receive any interest, or entitled to any compensation in connection with the funds withheld. 

5.3.10 Sellers must connect their payment processor account to the marketplace. Manual Payouts are provided only as a substitution to Automatic Payouts provided by our payment processor Stripe, and must not be used for large volume transactions. 

5.4 Fees

5.4.1 We, The Marketplace Operator, charge fees for using the Website Services at current rates as advertised on Pricing and Services Page. In addition, we may charge administrative fees when required.

5.4.2 All transactions attract a Seller’s Commission that must be paid by Sellers at the time of the transaction taking place. We automatically deduct the Seller’s Commission from Sellers’ earnings.

5.4.3 All Auction Listings also attract a Buyer’s Premium. The Buyer’s Premium is added to the cart total, and is paid by the buyer at the time of the transaction taking place.

5.5 Seller’s Subscriptions

5.5.1 We charge Sellers for Website Services via Subscriptions. Sellers must have current and valid Subscription for their account to be enabled for Selling. Having an account enabled for Selling is not mandatory.

5.5.2 All Subscriptions are valid for 30 days (the billing cycle) before being automatically renewed.

5.5.3 Subscriptions never expire, however can be cancelled at any time, or when renewal payment is declined we will cancel the subscription. The subscription will run until its expiration date.

 

5.5.4 All subscriptions have a 14 days Free Trial. The free trial period is added to the first billing cycle. Sellers will be charged for the first time at the end for the free trial, unless cancelled, so no payment is taken beforehand.

5.5.5 The free trial is available for new subscribers only. If you upgrade or downgrade your subscriptions during the free trial it will end automatically, and you will be charged the full amount for the new subscription.  

5.5.6 When subscriptions expire we will display the Seller’s listings included in their quota, and allow them to be sold. However, Sellers would not then be able to publish any additional listings, or edit listings already published.

5.5.7 All Subscriptions must be paid in full at the time of purchase. If a Subscription is upgraded we will charge the full amount of the new subscription, and any difference will be adjusted in the next billing cycle.

5.5.8 If a Subscription is downgraded we will charge the full amount of the new subscription, and the old subscription will be cancelled without any refund or adjustment. 

5.5.9 Selling Quota is the number of listings Sellers can publish at any one time depending on their subscription level. We reserve the right to change the status of any listings to Draft if the Selling Quota is exceeded. Sellers may decide which listings they wish to continue selling.

5.5.10 If a Seller runs out of their quota they can change other listings Status to Draft, and publish another listing instead, as long it is within their quota.

5.6 Resolution Process and Case

5.6.1 Unfortunately, not all transactions have a win-win outcome, and this occasionally should be expected for various reasons out of your or our control.

 

5.6.2 We are committed to maintaining the security of all Members and the integrity of Silverhammer Coin Auctions.

 

5.6.3 We are committed to supporting all parties and working together to help overcome any issues while members trade. We work effectively to answer concerns and to reach a fair outcome for all. 

5.6.4 The Resolution process is between the Buyer and Seller. Silverhammer representatives may step in to mediate if any case is not resolved to the satisfaction of the parties involved in a transaction. 

5.6.5 Members must follow Resolution procedures as described here. Using the resolution process without valid reason can lead to sanctions being placed on a member account, who violate these Terms and Conditions. 

5.6.6 The Marketplace Operator representatives will make fair judgements when necessary, and their decisions will be final. You have the right to appeal. 

5.6.7 You may take the matter further and use formal mediation or the law.

6.2 By accessing and using the Silverhammer Platform and the Website Services you must agree to our Seller’s Terms and Conditions.

6.3 If you use the Website from the United Kingdom you must read our guidance here. If you use the Website from any other region or country than the United Kingdom which has laws and regulations concerning selling goods on Online Marketplaces you must read our guidance here.

7.1.2 We assume no responsibility for the content of such Websites and disclaim liability for any and all forms of loss or damage arising out of the use of them.

7.1.3 The inclusion of a link to another site on this Website does not imply any endorsement of the sites themselves or of those in control of them.

7.1.4 If you use any Third-Party content you do so at your own risk and if you leave this Website to access such content then these Terms and Conditions are no longer applicable. We cannot be held responsible for any action you may take on these Third-Party Websites including any purchases or use of any of their services. 

7.2 Third-Party Advertisers

7.2.1 We may allow third-party advertisers to place advertisements and other information on our Website.

7.2.2 Advertisers agree to take full responsibility for any content, products or service they place on our Website.

 

7.2.3 Advertisers must be authorised to place adverts on this Website and hold full rights including intellectual property rights, publicity rights, and contractual rights.

7.2.4 Silverhammer Auction Ltd only provides adequate space to place adverts, and there is no any other relationship between Us and the Advertiser.

8. Member Generated Content 

8.1 Communication Standards

8.1.1 Member generated content is any content submitted to be displayed on our Website including all communications but not limited to writings, posts, activity posts, comments, forums and groups activity and comments, public and private messages, suggestions and recommendations, personal information, images, videos, audio, graphics, web links and any other functionality provided. 

8.1.2 The content generated may be viewable online or offline by other Members of the Website or anywhere on the internet.

8.1.3 By generating such content you agree to waive any rights for the content included but not limited to copyright, patent, trademark, or moral rights of any Member or third-party. 

8.1.4 You, the Member as the content creator and owner authorise Us, and any other Member, to use your Generated Content. Under these Terms and Conditions you hereby transfer to us, The Website Owner and Operator, or any other Members, any rights of distribution, public display, copying and reproduction and such use of the content will not infringe on Us on any intellectual property rights, including but not limited to copyright, patent, trademark, or moral rights.

8.1.5 If you post any Member Generated Content you give Us automatic licence to use or modify, copy and reproduce, store, and publicly display, translate, distribute, use for commercial purpose or advertising such content without restriction or limitation that is irrevocable, non-exclusive, transferable, royalty fee and fully paid.

8.1.6 We may amend or delete any Member Generated Contribution at any time and for any reason without a notice. This is at our own discretion. We are not responsible for, or monitor any Member Generated Contributions. 

8.1.7 You agree not to Generate Content that is false, inaccurate or misleading, and/or containing unauthorised advertising or promotional materials, pyramid schemes, gambling or gaming, spam, mass mailing, or act of solicitation or any other activity that may interfere with the proper and legitimate use of the Website by others.

8.1.8 In addition you agree to not use any vulgar or obscene language, harass, abuse or threaten other Members, in any way including via any objectionable content and communications. This decision as to what comprises these behaviours is ours and at our discretion.

8.1.9 Your contributions must not violate any applicable law, or criminal law concerning harassing, threatening, stalking, violence against any person, class of people or minority, race, nationality, gender, transgender, sexual orientation, child pornography or otherwise safeguarding or minors or vulnerable adults including any invasion of privacy.

8.1.10 Otherwise your Contributions must not violate these Terms and Conditions, or any applicable law, regulation or rule. Any breaches may result in an investigation against you, suspension or termination of your account and/or any right given to you in these Terms and Conditions.

8.1.11 Authors agree to be solely responsible for opinions expressed and to follow the “read, think and then respond” process. 

8.1.12 Before you repost any information from another website or social media it’s a good practice to Fact Check first. This is to prevent unintended misunderstandings or arguments emerging spoiling the enjoyment of using the Website, and to keep Members safe and scam free.

8.1.13 Members agree to communicate in a manner that is polite, respectful and courteous and to avoid denigration.

8.1.14 Members agree to avoid writing any message in capital letters that could be interpreted as shouting and to consider the tone of the given message, avoiding hate speech and flame wars, sarcasm and inappropriate jargon, slang or idioms. 

8.1.15 Members agree to respect privacy and everyone’s right to free speech. Avoid sharing personal information or any information that is not in the subject of this Website.

8.1.16 Avoid getting involved in conversations concerning Politics and Religion. 

8.2 Public and Private Messaging System

8.2.1 Silverhammer Website allows Members to send private and public messages to each other. Public messages can be seen by all Members. 


8.2.2 Private messages can be seen only by the recipient and are intended to be viewed only by the recipient and are confidential. We reserve the right to view and read all private messages sent privately to ensure compliance with these Terms and Conditions by its author. We have a duty of care to ensure that all private messages are confidential, unless there is a violation of these Terms and Conditions. 

8.2.3 Private or Public messages must not violate these Terms and Conditions or any applicable law or rule, especially Communication Standards as described in point 6.1 of these Terms and Conditions.

8.2.4 Private or Public messages must not contain any sensitive and private personal information, contact numbers or email addresses, any solicitation for sale, purchase, auction or otherwise transfer ownership of any item, any advertising, sway to avoid paying any fees due for services provided by Silverhammer Ltd or any intent to violate or bypass these Terms and Conditions.

8.2.5 We provide a Support Center on the Website. Any submissions, questions, comments, messages or feedback is governed by the Communication Standard of these Terms and Conditions.

8.2.6 You agree that these submissions are non-confidential and become our property. We reserve the right to  use the Submissions for any lawful purpose, whether commercial or otherwise. You transfer all rights to the Submissions and will not hold us liable for any rights infringement, including all intellectual property rights. 

8.3  Two-Way Member and Seller Reviews System

8.3.1 The 2-way feedback system and rating allows Members and Store Owners to review transactions and share experiences they had with the other party. This helps to build authority, reputation and trust among all Users of the Website.

8.3.2 Silverhammer’s Operator is not involved in writing any feedback or submitting any rating; therefore we are not responsible for any content shared. 

8.3.3 The review system’s feedback and rating is designed to review buyer or seller conduct and professionalism during a sale transaction including meeting any obligations concerning contract of sale entered, and give relevant rating in scale from 1 to 5, when 1 is Poor Experience, 2 is Fair Experience, 3 is Good Experience, 4 is Very Good Experience and 5 is Excellent Experience. 

8.3.4 Both the Buyer and the Seller are entitled to leave a review and a rating for each other once per transaction after they have interacted together or have had an experience taking part in a transaction of sale.

8.3.5 We will display feedback received in a location depending if you are the seller or buyer of a given transaction. Respectively, this is shown in your Store profile and listing detail page, and Member profile.

8.3.6 Feedback provided is content similar to a public message and therefore fails under the same terms described in point 6.2 of these Terms and Conditions, they should not contain any abusive, racist, offensive, discriminatory or hate language.

8.3.7 Please ensure that review and rating is not left prematurely, or by mistake as any amendments are not possible. Usually, the review and rating is provided when a transaction is completed, payment is confirmed and the item(s) received. 

8.3.8 If an item was lost in transit, especially for reasons out of the seller’s control, this should not grant a right for the buyer to leave negative feedback, but a seller’s willingness to provide updates, resolution and their good communication at all times is paramount to every transaction’s success and a positive review as a result.

8.3.9 By engaging in Selling or Buying on this Website you agree to not leave any misleading or unfair feedback, or use the Review System for personal gain, pay others for positive reviews, or use other accounts to elevate review rating scores. 

8.3.10 You should not be affiliated to the other party in any way when leaving reviews and ratings, or affiliated to their competitor. 

8.3.11 Organising any events encouraging other Members to post reviews is prohibited, whenever it is free or paid for. 

8.3.12 Leaving a Review is not obligatory. If you receive a review from another Member you are not obligated to  do the same in return. We recommended that reviews are provided by buyers and sellers to ensure that all standards are maintained.

8.3.13 Any attempt to  leave a review and rating that is untrue, or attempt to intentionally maliciously discredit a Member or Store Owner would be considered as misconduct and we reserve the right to investigate and take appropriate measures to prevent such action in the future which in these Terms and Conditions includes account suspensions or closure without a notice. 

8.3.14 Members or Store Owners who received multiple negative reviews and low ratings could be subject to an investigation in an attempt to support them in understanding reasons behind the negative reviews received and how to achieve better outcomes in the future.

8.3.15 If this happens Members or Store Owners affected are required to take necessary steps as recommended by the Marketplace Operator to avoid future negative review and low feedback left on their account. This is to protect their name, and the Marketplace Operator name, and the Website credibility. 

8.3.16 We reserve the right to amend or delete any review or rating in our sole discretion. However, we have no obligation to delete any review or rating that has been found unfair or inaccurate by any Member. 

8.3.17 We do not endorse any reviews, nor accept any liability or claim for any losses whenever material or intellectual, as a result of any review received.

8.5.1 Members can create Groups dedicated to Members who share an interest in collecting similar collectible items.

8.5.2 Group admins have full control over the Group content, and are responsible for their group contents and moderation, their group management, and member management, and to promote other members as admins and moderators. 

8.5.3 Group admins have the right to change group status, change the cover image, manage membership including promotions and bans, and to delete their group. 

8.5.4 Group admins should follow these Terms and Conditions, especially including those points that describe Member Generated Content and Communication Standards when moderating their Group content.

8.5.5 All a Groups’ content is governed by these Terms and Conditions, especially Member Generated Content point 6.1 (Communication Standards) and point 6.2 (Public and Private Messaging System).

8.5.6 Groups title, description and content should be relevant to this Website and their Members.

8.5.7 By creating a Group you agree to use Groups for the purpose of sharing knowledge and educating others. Groups for the purpose of selling and buying or auctioning items, advertising or any gambling or raffle games or competitions are prohibited. 

8.5.8 You agree to not misuse a Group for any reason prohibited by these Terms and Conditions, including but not limited to any criminal purpose or any reason that violates any applicable laws and rules. 

8.5.9 If you as a Member join a group you agree to follow their Terms and Conditions, and any Groups rules and regulations, including any code of conduct set by Groups Admins. 

8.5.10 Group Moderators have special access to moderation tools only. Their role is to ensure that all members and the content of a Group is compliant with these terms and conditions, and the group rules or code of conduct. 

Moderators have special rights to edit, close or delete any topic, message or content.

8.5.11 We, the Marketplace Operator, reserve the right to amend groups’ content, or to delete a Group permanently without any notice if it violates any of these Terms and Conditions, or any applicable laws.

 

8.6 Forums

8.6.1 Forums are only available in Groups to ensure that the content is well organised and most relevant to a group subject of interest.

8.6.2 The Group Forum is  provided for Members to share their knowledge and experiences, and should not be used for any other purpose.

8.6.3 The forums are governed under the same rules as Public Messages. Please refer to point 6.2 of these Terms and Conditions for acceptable behaviour and conduct.

8.6.4 It is expected that all communications are friendly and welcoming for all. 

Members should ensure that if they take part in conversations then all comments or input should relate to the topic subject. 

8.7 Images, Graphics, Videos and Audio Content 

8.7.1 Members are responsible for all their Content Generated on the Website or uploaded into the Website including images, graphics, video and audio clips.

8.7.2 If you upload or share any of such content in any space on this Website you agree to not upload content that is not relevant to the Website or its Members. Specifically this means material outside the interest of content relevant to Numismatics, Notaphily, Militaria or Paleristics, Exonumia, or other listing categories available on this Website.

8.7.3 You will not upload or share content containing offensive gestures, nudity, pornography, hate, gore, minors, advertising, drugs, alcohol, arms and weapons, gambling and investments and any scannable bar codes or QR codes. 

8.7.4 Images included in listings showing items for sale must not be altered in any way, colour adjusted or blurred, or in any way digitally processed to conceal defects or details. 

9. Safeguarding

9.1 We take Safeguarding of our Members very seriously to ensure that this Website and the community within it is a safe and welcoming online environment for all.

9.2 Members of this Website should be able to access and use it without being subjected to any inappropriate behaviour from other Members as stated in these Terms and Conditions in point 6 (Member Generated Content).

9.3 We are providing all Members with certain tools to flag or report inappropriate  content or block any other Member. 

9.4 These tools should be used appropriately and with care, and to not violate any other Member’s rights, these Terms and Conditions or any applicable laws. 

9.5 Silverhammer Operators appoint Moderators. Moderators are responsible for reviewing the Marketplace Listings, Member Generated Content and Communication Standards ensuring that the Silverhammer Platform stays safe and enjoyable for all. In addition, Moderators ensure that all Members’ activities comply with these Terms and Conditions.

9.6 Moderators have special capabilities to view and read all Member Generated Content and act appropriately to ensure compliance.

9.7 Moderators can change Marketplace Listings Status for one or more listings and remove them from the Marketplace if it or they violates these Terms and Conditions. This is at the Moderator’s  own discretion.

9.8 Moderators can remove listing from a listing category, or move it to a more appropriate listing category. 

9.9 Moderators are responsible for reviewing Member Generated Content flagged or reported by other Members. They can block or suspend Member accounts at their own discretion, and investigate any violations of these Terms and Conditions.
